Storm Giant LLC is not an automobile broker, dealer, or traditional auctioneer.
We do not engage in the direct sale, purchase, or exchange of vehicles listed on our platform.
Storm Giant LLC does not hold title, inspect, or take possession of any vehicle listed on CheckWithTheWife.com.

Application and Acceptance of the Terms of Use

By accessing or using the digital services provided by CheckWithTheWife.com, you agree to be bound by these Terms of Use (including the binding arbitration provision detailed in the section titled “Dispute Resolution (Arbitration Clause and Class Action Waiver)”) along with our Privacy Notice, any FAQs, and any additional guidelines, terms, procedures, or rules that apply to specific features or functionality of our platform (collectively referred to as the "Agreement"). n addition to the services explicitly described in these Terms of Use, we may provide additional or customized services. Unless a separate, signed agreement specifically overrides these Terms of Use, this Agreement will govern those services as well.
The Agreement constitutes a contract exclusively between you and Storm Giant LLC. It does not regulate any sales, transactions, or other interactions between you and other users, third parties, buyers, or sellers on the platform.

Your Responsibilities

Accuracy of Information: You are responsible for ensuring that all information you provide to us in connection with your use of the digital services is accurate and up to date.
Content You Provide: You are solely accountable for the information and content you submit, including any details associated with your vehicle listings.
Your Conduct: Your behavior while using the platform must comply with the guidelines outlined in the section titled “Your Conduct and Responsible Use of the Digital Services” in these Terms of Use, as well as any additional rules provided by us that are applicable to your account or use of the platform.

Intellectual and Other Proprietary Rights

All rights, title, and interest in the copyrights, trademarks, service marks, trade names, patents, and any other intellectual or proprietary rights associated with the digital services and content provided by CheckWithTheWife.com are owned exclusively by Storm Giant LLC, except where your User Content applies.
You are prohibited from building a business, reselling, redistributing, recirculating, or engaging in any commercial use of the digital services or content provided by CheckWithTheWife.com, including creating derivative works or utilizing any portion of the digital services (including software code), whether for profit or not.
If it is determined that a user has repeatedly infringed on the proprietary rights of third parties, Storm Giant LLC may terminate that user's access to the digital services. We reserve the right (but are not obligated) to review any submitted content, investigate potential violations, and take any appropriate action in our sole discretion.

Release, Indemnity, Disclaimers, and Limitation of Liability

You release Storm Giant LLC, its affiliates, service providers, partners, and their respective officers, employees, contractors, and agents from all damages, losses, liabilities, costs, or expenses arising from any dispute with other users or third parties related to your use of the digital services.
You agree to indemnify and hold Storm Giant LLC and its affiliates harmless from any damages, losses, liabilities, costs, or expenses (including reasonable attorney and accounting fees) resulting from claims, demands, suits, or investigations arising out of:

Your use of the digital services or content.
Your User Content.
Your violation of these Terms of Use.
Your violation of applicable laws or regulations.
Actions or inactions of any third party you authorize to use your account or credentials to access the digital services.

Storm Giant LLC provides the digital services “as is” without warranties of any kind.
Our liability is limited as detailed in the Limitation of Liability section of these Terms of Use.

Third Parties

Storm Giant LLC is not responsible for any third-party links, websites, apps, or services, including social media platforms, that may be accessed through the digital services.
We may participate in affiliate marketing, and some digital services may include affiliate links, from which we may earn a commission if you click or make purchases.

Termination

Storm Giant LLC reserves the right to terminate your account, password, or access to the digital services at any time, with or without notice, for any reason or no reason. We may also remove or discard any user content or information stored, sent, or received via the digital services.

Changes to the Terms of Use

We may update these Terms of Use prospectively by posting revised terms on the digital services or notifying you via email or other forms of communication. Your continued use of the digital services after revisions indicates your acceptance of the updated terms.

Governing Law and Severability

These Terms of Use are governed by the laws of the State of Virginia, USA, without regard to conflict-of-law principles.
This Agreement, including the Privacy Notice and any additional terms or rules applicable to specific features, constitutes the entire agreement between you and Storm Giant LLC.
If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be modified to the extent necessary to make it enforceable under the law.

If you believe your copyright has been infringed, you may submit a notice in accordance with the procedures detailed in the corresponding section of these Terms of Use.
